On August 18, 2013 at 12:18 am, an officer with the Fairview Township Police Department was on patrol in the area of Lewisberry Road and the Interstate 83 North entrance ramp. The officer observed that traffic was backing up on the ramp. Upon investigating the reason, the officer located a Ford sedan that had driven partially up onto the concrete barrier that separates the entrance and exit ramps.
The officer then made contact with the driver of the car, 22 year old Jared Winters of the 700 block of Market Street in New Cumberland and a juvenile male. The officer immediately detected an odor of marijuana coming from the vehicle. The officer also observed drug paraphernalia on the floor of the vehicle.
Upon talking to Winters, the officer detected a strong odor consistent with that of an alcoholic beverage coming from his breath. His eyes were also observed to be glassy and blood shot in appearance and his speech was slurred. Once outside of the vehicle, Winters was found to be very unsteady on his feet to the point that the officer had to catch him as he was falling over.
After a tow truck was able to pull the car off of the concrete barrier, an officer observed a plastic container between the driver’s seat and the center console that contained suspected marijuana.
Winters was subsequently arrested for DUI, possession of a small amount of marijuana and possession of drug paraphernalia. He was transported to the York County judicial center for processing and arraignment. He was arraigned before Magisterial District Judge David Eshbach and committed to York County Prison on $2,500 bail.
